Pennsylvania is an equitable distribution state, which means that all debts and assets acquired during the marriage, with the exception of inheritances and gifts, must be divided equitably (not necessarily equally) between the parties. When you hire me to assist you with the division of debts and assets, I will first review all of the debts and assets that may be a part of the marital estate, to determine if there are any non-marital portions. I will examine all assets of the marriage, including real property, bank accounts and investments, retirement funds and business assets.
In the process of evaluating your debts and assets and preparing a proposal for the equitable distribution of property, I will also look for any hidden assets. I will also make certain that any assets that came to you as gifts are excluded from the marital estate.
