My Support Practice
At my offices, I advise clients regarding:
- Child support. In Pennsylvania, child support is calculated using a state-mandated formula, which takes into consideration the income of the respective parties, the need for health insurance or day care, and any other unique factors based on the reasonable needs of the children. I will review any proposed support order to verify that it complies with state guidelines and that it properly includes all relevant income, such as seasonal income, commission income and self-employment income. I will help determine the "reasonable needs of the children."
- Spousal support or alimony pendente lite. In Pennsylvania, a spouse may be awarded alimony pendente lite or spousal support at a rate of up to 40% of the difference between the net monthly income of the parties. I will help you determine whether this support is warranted and, if so, the amount, frequency and duration of payments. I will also make certain that the earning capacity of both parties are fairly considered. Once a divorce is filed in Pennsylvania, a dependent spouse may be entitled to alimony pendente lite, which covers the period before the divorce is final.
- Alimony. Alimony is support paid to the spouse after the divorce is final. These payments are tax deductible to the payor and is included as income to the payee. The amount and duration of alimony will be determined as part of your overall divorce and equitable distribution settlement.
- Child support and alimony modifications. If your divorce is final, but your circumstances have changed significantly, I can help you seek modification of your existing child support or alimony order. I can also help you in contempt proceedings seeking enforcement of a support or alimony order.
